Terms of Service

1. Definitions

• "Company," "we," "us," or "our" refers to Virtual Freedom Academy Limited, trading as Draftbox.
• "Service" refers to the Draftbox software platform, including all tools, features, credits, and resources available at draftbox.ai.
• "User," "you," or "your" refers to the individual or entity using the Service.

2. Use of Service

2.1 Eligibility. You must be at least 18 years old to use the Service.

2.2 Account Registration. You agree to provide accurate and complete information when registering for an account.

2.3 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately at support@draftbox.ai if you suspect unauthorised access.

3. Service Description

Draftbox is an AI-powered website section design tool. The Service allows you to:

• Generate website sections (hero, features, testimonials, etc.) using natural language prompts
• Upload images and apply brand style guides to customise generated sections
• Edit, save, and manage generated sections
• Preview assembled pages from your generated sections
• Export sections to third-party tools such as Figma
• Save favourite sections for future use

Each section generation consumes credits as described in Section 5.

4. Subscriptions & Payments

4.1 Free Tier. Upon registration, you receive a limited number of free credits. No payment information is required.

4.2 Subscription Plans. The Service is available on a recurring subscription basis (monthly). Subscriptions renew automatically unless cancelled before the next billing date. Your subscription includes a monthly credit allocation.

4.3 Credit Packs. Additional credits may be purchased as one-off credit packs at published prices.

4.4 Payment Processing. All payments are processed securely by Stripe. We do not store your credit card or payment details on our servers.

4.5 Price Changes. We reserve the right to change pricing at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect on their subscription.

5. Credits

5.1 Credit Usage. Each section generated consumes one credit per section per variation. For example, generating 3 variations of a hero section uses 3 credits.

5.2 Credit Rollover. Unused subscription credits may roll over to the following month as long as your subscription remains active.

5.3 No Cash Value. Credits have no cash value and cannot be exchanged, transferred, or refunded except as outlined in our Refund & Cancellation Policy.

6. Intellectual Property

6.1 Platform Ownership. All content, software, text, graphics, logos, and related materials within the Service are owned by or licensed to Virtual Freedom Academy Limited.

6.2 Your Output. Website sections, designs, and materials you create using Draftbox are yours. We claim no ownership over your generated output.

6.3 License to Use. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for personal or business purposes, subject to these Terms.

6.4 Restrictions. You may not:

• Reproduce, copy, or redistribute the Service or its source code
• Reverse engineer, decompile, or attempt to derive the source code
• Rent, lease, sublicense, or share your account with others
• Resell or redistribute access to the Service itself

7. User Conduct

You agree not to:

• Use the Service for unlawful purposes or to generate harmful, offensive, or illegal content
• Violate third-party intellectual property rights
• Attempt to gain unauthorised access to the Service or its systems
• Upload or transmit malicious code, bots, or automated scraping tools
• Abuse the credit system or exploit the Service beyond fair use

8. Refunds & Cancellations

8.1 No Refunds. All subscription and credit pack sales are final. We do not issue refunds for change of mind, lack of usage, or brief trial periods.

8.2 Cancellation. You may cancel your subscription at any time. You will retain access until the end of your current billing period. No partial refunds are provided.

8.3 Digital Waiver. By subscribing, you request immediate access to the Service and waive your statutory 14-day right of withdrawal under the Consumer Contracts Regulations 2013.

9. Support & Disputes

9.1 Official Support Channels. Our primary support channel is email at support@draftbox.ai.

9.2 Direct Resolution Required. You agree to contact us through our official support channels and allow us a reasonable opportunity to resolve any issues before initiating chargebacks or third-party disputes.

9.3 Chargebacks. By using the Service, you agree not to initiate chargebacks for services delivered or accessible. If you do, we may suspend or revoke your account, recover fees, and apply a reasonable administrative charge where permitted by law.

10. Third-Party Integrations

The Service integrates with third-party tools and APIs (such as Figma export via To.Design, Google Fonts, and Stripe for payments). You are responsible for any fees charged by those third parties. We are not responsible for the availability, accuracy, or policies of third-party services.

11. Disclaimer of Warranties

11.1 The Service is provided "as is" and "as available."

11.2 We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11.3 We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated output will meet your specific requirements.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, Virtual Freedom Academy Limited shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

12.2 Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Virtual Freedom Academy Limited from any claims, damages, or expenses (including legal fees) arising out of:

• Your use of the Service
• Violation of these Terms
• Infringement of any third-party rights
• Content you generate or publish using the Service

14. Governing Law & Jurisdiction

14.1 These Terms are governed by the laws of England and Wales.

14.2 You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising under these Terms.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We will notify users of material changes via email or in-app notice.
